TERMS & CONDITIONS – REAL ESTATE AND COMMERCIAL PHOTOGRAPHY

1. Booking and Reservations

Photography services can be booked by phone, email, contact form or via direct message on social media.
The date and location of the photoshoot become binding only after written confirmation by both parties.

A standard price list for real estate photography and drone services is available on the website.
For other types of projects (e.g. hotels, commercial properties, development projects, hospitality venues, industrial sites), an individual quotation is prepared based on the scope and specifics of the assignment.
The quotation must be approved in writing prior to the photoshoot.

2. Scope of Work and Service Area

I operate primarily in the Plzeň, Central Bohemian, Karlovy Vary and South Bohemian regions.
For larger assignments, travel across the Czech Republic or abroad is possible. Travel costs are charged according to the valid kilometre rate; if required to arrive the day before, accommodation costs may also apply.

Drone Photography

I hold a valid drone licence and fly in accordance with the regulations of the Civil Aviation Authority.
Drone photography is only possible in suitable weather conditions and in locations where it is legally permitted.

Client's Responsibility – Preparation of the Space

The client is responsible for ensuring access to the property, for preparing the space (cleaning, basic staging), and for obtaining any necessary permissions from owners, managers or operators of the premises.
A pre-shoot checklist can be provided upon request.

Scouting and Pre-Production for Larger Commercial Projects

For extensive assignments, a scouting phase is required to properly plan the photoshoot.

Scouting includes:

  • evaluating lighting conditions throughout the day
  • identifying key locations for shooting
  • verifying logistical and access possibilities
  • confirming drone operation requirements and restrictions
  • planning the shooting order for efficient workflow

Part of the scouting and preliminary scheduling is carried out before arriving on site.
For projects outside Plzeň (my base location), this phase is conducted via phone consultation, online meeting, or based on materials provided by the client (photos, videos, floor plans, project description).

A flexible shooting schedule is then created to ensure smooth execution.

Client Assistance During the Photoshoot

A responsible person must be available on site during the shoot to assist if needed — particularly with small adjustments to the space, moving objects, or providing access to individual rooms.
The photographer does not perform cleaning or heavy furniture rearrangement.

3. Delivery of Photographs

Real Estate Photography

Final edited photos are delivered within 48 business hours.
Files are delivered via an online protected gallery, accessible for 90 days. An automatic reminder is sent 3 days before expiration.
For best quality, download images to a computer, not a mobile phone.
Express delivery (within 24 hours) is available for an additional fee.

Other Assignments (hotels, commercial spaces, portraits, events, etc.)

Although a final number of photos is agreed in advance, more shots are taken during the session.

Workflow:

  1. Within 7 business days after the session (and return to the office), unedited previews are sent to the client.
  2. The client selects the images to be edited and sends their selection back.
  3. Final editing is completed within 7 business days after receiving the client's selection.

If the client's response time is delayed (business trip, holiday, etc.), this must be communicated in advance to avoid timeline issues.

Once the selection is received, the client is informed of the estimated completion date, depending on current workload.
Typical delivery time for these assignments is 10–14 days.

4. Commercial Licensing & Copyright (Use of Photographs)

All photographs are the author's copyrighted work.
Payment for the photoshoot does not grant ownership of copyright — only a licence to use the images as specified below.
Copyright always remains with the photographer.

Standard Commercial Licence (included in the photoshoot price)

The client receives a non-exclusive, indefinite licence for:

  • presenting the property or company on websites
  • publishing on real estate portals
  • use on social media
  • use in printed promotional materials (flyers, brochures)
  • internal marketing purposes

Extended Licence (for an additional fee)

Required for:

  • large-format printing (billboards, roll-ups, banners, posters)
  • printing wall art or decorative products
  • any use exceeding regular marketing presentation
    Extended licences are negotiated individually.

Prohibited Without Written Consent

  • resale or distribution of photos to third parties
  • uploading to stock agencies
  • transferring the licence to another party
  • large-format printing without an extended licence
  • modifying the images (filters, recolouring, retouching, cropping that affects composition)

All modifications must be approved in writing.

Use of Photographs for the Photographer's Portfolio

The photographer may use selected photographs for self-promotion, including website, portfolio, social media and marketing materials.

Backstage photos and short videos may also be taken and used for promotional purposes.

If the client does not agree with the publication of final images or backstage materials, this must be communicated in writing before the photoshoot.

Mutual tagging on social media is appreciated when posting shared content.

5. Archiving

RAW files are not provided to clients and are stored for 1 month for internal purposes only.
Final JPG images remain available in the online gallery for 90 days.
The client receives an automated reminder 3 days before deletion.

The client is responsible for downloading and backing up all images.
After the gallery expires, re-delivery cannot be guaranteed.

6. Cancellation and Rescheduling

Standard Local Assignments

Cancellation or rescheduling is free of charge up to 1 day before the scheduled date (until 18:00).
Later cancellation may incur charges for actual expenses already incurred (e.g. travel).

Assignments Requiring Travel or Accommodation the Day Before

If the assignment is cancelled after travel or accommodation costs have been incurred, the client pays all actual proven expenses.

Same-Day Rescheduling

Possible only when the shoot is objectively impossible due to:

  • unsuitable weather (rain, strong wind, storm)
  • drone restrictions or flight bans
  • safety reasons

In all other cases, a same-day cancellation is considered a storno, and expenses may be charged.

7. Payment Terms

Real Estate Photography

  • New clients: payment in cash or by QR code immediately after the shoot.
  • Regular clients: payment based on invoice, due in 14 days.

Other Assignments (hotels, commercial properties, portraits, development projects, etc.)

New clients – assignments not requiring travel the day before

  • A 40% deposit is paid on the day of the shoot.
  • The remaining balance is due after post-production and before delivery of final images (invoice due in 7 days).

Assignments requiring travel or accommodation the day before

  • The 40% deposit must be paid before departure.
  • Without the deposit, the trip cannot be commenced.
  • Remaining balance: due after post-production (7-day invoice).

Regular clients

  • Payment by invoice after post-production and before delivery of final files.
  • Invoice due in 14 days.

8. Personal Data Protection (GDPR)

The photographer processes clients' personal data solely for communication, execution of the assignment and legal obligations.
Data is treated confidentially and never shared with third parties for marketing purposes.
The client may request correction or deletion of their data at any time.

9. Confidentiality (NDA)

The photographer maintains confidentiality regarding all non-public information obtained during the project, especially development projects, hotels before opening, internal company areas and other sensitive locations.

No photographs or backstage content from such projects will be published without the client's prior written consent.

The photographer may also refuse publication if it is not appropriate due to the nature of the assignment.

Clients must inform the photographer about any confidentiality requirements before the photoshoot.

I cooperate with many real estate agents and commercial clients, and I value long-term relationships built on trust and professionalism. All shared information remains confidential.
